الملخص

هدفت الدراسة إلى بيان أهمية الاستصناع كبديل مشروع للتمويل الاستثماري التقليدي، فبالرغم من تعدد مصادر التمويل بالطرق التقليدية، إلا أن معظم المسلمين أحجموا عنه بسبب التعاملات الربوية، مما جعل من الضرورة إلقاء الضوء على الآليات التمويلية والاستثمارية المتوافقة مع الشريعة الإسلامية والتي من بينها الاستصناع لاستقطاب هذه المدخرات وتشغيلها بالشكل الأمثل. بالتالي هدفت هذه الدراسة إلى بيان إمكانية تطبيق صيغة مهمة من صيغ التمويل الإسلامي وهي الاستصناع كأداة مثالية وفعالة للتطبيق في تنمية وتطوير المجالات الاقتصادية والاستثمارية المختلفة في الجمهورية العربية السورية، حيث أثبت الاستصناع كفاءته في العديد من المجالات المختلفة مثل مجالات التنمية الاقتصادية والتجارية والصناعية والزراعية والسياحية والتعليمية وغيرها. وخلصت الدراسة إلى وضع عدد من النماذج التطبيقية لعقود الاستصناع التي يمكن أن تطبق في سورية وهي: النموذج الأول هو التمويل بالاستصناع والاستصناع الموازي الذي يمكن استخدامه لتطوير القطاع الصناعي والقطاع الزراعي وقطاع البناء والإسكان العقاري. والنموذج الثاني هو نموذج التمويل بالاستصناع وعقد الـ (B.O.T) الذي يتميز بإمكانية استخدامه لتمويل المشاريع الضخمة كمشاريع تطوير البنية التحتية. والنموذج الثالث هو نموذج صكوك الاستصناع الذي يتميز باستخداماته المتنوعة بسبب قدرته على استقطاب تمويلات ضخمة بالإضافة إلى إمكانية تكييفه مع صيغ التمويل الإسلامية الأخرى مثل: الإجارة والمشاركة والمضاربة، وبالتالي يعد استخدام صكوك الاستصناع مثالياً لتمويل محطات الطاقة الكهربائية والشمسية، ومشاريع البنى التحتية بشكل عام، وقطاع الإسكان العقاري في سورية. وقد قدمت الدراسة مجموعة من التوصيات أهمها: على المصارف الإسلامية السورية التوجه نحو الاستثمار الحقيقي والدخول في عقود أكبر مثل عقود الاستصناع والمشاركات والمضاربة بما يناسب متطلبات مرحلة إعادة الإعمار القادمة، وذلك لمناسبة هذه العقود وبخاصة الاستصناع في توفير التمويل اللازم لتطوير مختلف القطاعات في سورية، والعمل على إصدار تشريعات تنظم عقود الاستصناع، إما على شكل قانون مستقل، وإما بإدراجها ضمن القوانين العامة التي تنظم الأسواق المالية، بكل مكوناتها وأدواتها، وضرورة قيام السلطات والهيئات الاقتصادية المختصة في سورية، بالعمل على وضع الآليات والإجراءات التنظيمية والإدارية اللازمة لتطبيق عقود الاستصناع بكافة أشكالها، وإجراء التعديلات القانونية الضرورية، لإزالة جميع العوائق القانونية والتنظيمية.

This study aimed to show the importance of Istisna'a as an Islamic alternative to traditional investment financing, despite the multiplicity of sources of financing by traditional methods, but most Muslims refrained from it because of usurious transactions, which made it necessary to shed light on the financing and investment mechanisms compatible with Islamic law, including Istisna'a to attract these savings and operate them optimally, so this study aimed to show the possibility of applying an important form of Islamic finance, which is Istisna'a as an ideal and effective tool for application in the development of various economic and investment fields in the Syrian Arab Republic, where Istisna'a has proven its effectiveness in many different fields such as economic, commercial, industrial, agricultural, tourism, educational fields and many other fields; The study concluded to develop a number of applied models for Istisna'a contracts that can be applied in Syria, namely: the model of financing by istisna'a and parallel Istisna'a, which can be used to develop the industrial sector, the agricultural sector, the construction sector and real estate housing; and the second model is the model of financing by istisna'a and the contract of (B.O.T), which is characterized by the possibility of using it to finance mega projects such as infrastructure development projects; and the third model is the model of Istisna'a sukuk, which is characterized by its various uses due to its ability to attract huge financing in addition to the possibility of adapting it to other Islamic financing forms such as Ijarah, Musharaka and Mudaraba, the use of Istisna'a Sukuk is ideal for financing electric and solar power plants, infrastructure projects in general, and the real estate housing sector in Syria; The study made a set of recommendations, the most important of which are: Syrian Islamic banks should move towards real investment and enter into larger contracts such as Istisna'a contracts, Musharaka and Mudaraba to suit the requirements of the next reconstruction phase, in order to suit these contracts, especially Istisna'a, in providing the necessary funding for the development of various sectors in Syria; working to issue legislation regulating Istisna'a contracts, either in the form of an independent law, or by including them within the general laws that regulate financial markets, with all their components and tools; the need for economic authorities and bodies competent in Syria, to work on developing the necessary organizational and administrative mechanisms and procedures for the application of Istisna'a contracts in all their forms, to make the necessary legal amendments, to remove all legal and regulatory obstacles
