الملخص

كفل القانون الدولي للمرأة الفلسطينية أثناء اعتقالها من قبل قوات الاحتلال الإسرائيلي مجموعة من الحقوق؛ بهدف حمايتها والمحافظة على شرفها وإنسانيتها، إلا أن دولة الاحتلال تتجاهل تلك الحقوق، وتضرب بها عرض الحائط، وتمارس كافة أشكال الانتهاكات، وتتنكر لاتفاقيات جنيف الأربعة رغم مصادقتها عليها، وتطبق على الأسيرات والمعتقلات قوانينها العنصرية الخاصة، وترتكب بحقهن جرائم حرب وجرائم ضد إنسانية، الأمر الذي يدفعنا للقول أن الأسيرات والمعتقلات الفلسطينيات في سجون الاحتلال بحاجة ماسة الى حماية دولية خاصة، تدفع عنهم جرائم وانتهاكات قوات الاحتلال الإسرائيلي.وتهدف هذه الدراسة للتعرف على مفهوم الأسيرة، ومعرفة الفرق بين الأسيرة والمعتقلة، وتوضيح التكييف القانوني الصحيح للأسيرات والمعتقلات في سجون الاحتلال، وتوضيح الحماية القانونية التي يوفرها القانون الدولي الإنساني لهن، وبيان الآليات القانونية المتاحة لمواجهة الانتهاكات الإسرائيلية بحقهن، واثبات المسؤولية الجنائية الدولية الفردية لقادة ورؤساء دولة الاحتلال بسبب ارتكابهم جرائم تعد دولية تندرج تحت اختصاص المحكمة الجنائية الدولية.اعتمدت الباحثة في هذه الدراسة على المنهج الوصفي والمنهج التحليلي، وذلك من خلال دراسة حقوق الأسيرات والمعتقلات الفلسطينيات، وفق اتفاقيات جنيف الأربعة، والاتفاقيات الأخرى، فستقوم بدراسة تحليلية لحقوق الأسيرات والمعتقلات الفلسطينيات في الاتفاقيات الدولية، وتبرز الانتهاكات الإسرائيلية بحقهن، وتوضح المسؤولية القانونية المترتبة على تلك الانتهاكات.ومن أهم النتائج التي توصلت إليها الباحثة ثبوت ارتكاب قوات الاحتلال لجرائم دولية تتمثل في جرائم الحرب والجرائم ضد الإنسانية بحق الأسيرات والمعتقلات الفلسطينيات، من خلال انتهاك غالبية الحقوق المنصوص عليها في الاتفاقيات الدولية، ويتحمل قادة وجنود الاحتلال المسؤولية المدنية والجنائية عن تلك الانتهاكات، كما خلصت الدراسة إلى أن الحماية المتوفرة حالياً للأسيرات والمعتقلات في سجون الاحتلال هي حماية قاصرة، لا تُلبي الحد الأدنى من المنصوص عليه في الاتفاقيات الدولية.وفي نهاية الدراسة قدمت الباحثة مجموعة من التوصيات أهمها دعوة السلطة الفلسطينية للتوجه إلى محكمة العدل الدولية؛ للحصول على فتوى قانونية حول الوضع والوصف القانوني للأسيرات والمعتقلات داخل سجون الاحتلال الإسرائيلي، وذلك لحسم الخلاف القانوني حول توصيفهم، ودعوة اللجنة الدولية للصليب الأحمر لزيادة فعاليتها ودورها الرقابي في الأراضي الفلسطينية، وضرورة ان تُمارس ضغوطات حقيقية على سلطات الاحتلال الإسرائيلي؛ لإلزامها بتطبيق اتفاقيات جنيف على الأسيرات والمعتقلات الفلسطينيات.

AbstractThe international law guaranteed a set of right for the Palestinian woman, during being arrested by the Israeli occupation, for protecting her and preserving her humanity and honor. However, the occupation forces neglect these rights, practice all forms of humiliation and deny the four agreements of Geneva although they approved them. They also apply their racist laws against male and female prisoners, and commit war and inhuman crimes. This leads us to say that female Palestinian prisoners in the Israeli prisons severely need a private international protection against the Israeli crimes and violation.This study aims at identifying the female detainees and prisoners in addition to explaining the right characterization of the arrested and prisoners in the occupation prisoners. The study also aims at showing the legal protection provided for them by the international humanitarian law and the available legal mechanism to face the Israeli violation against them in addition to approving the individual international criminal responsibility of the leaders and presidents of the occupation due to committing international crimes within the jurisdiction of the International Criminal Court.The researcher used the descriptive and analytical approach though studying the rights of the female Palestinian detainees and prisoners according to the four agreements of Geneva and other agreements. The researcher will also make an analytical study for the rights of the female Palestinian detainees and prisoners in the international agreements. The study will clarify the Israeli violation of them, and the legal responsibility towards these violations.The results of the study revealed that the occupation forces commit international crimes represented by war and inhuman crimes. These crimes are committed through the violation of the majority of the crimes approved in the international agreements, and that the occupation leaders and soldiers are secularly and criminally responsible for these violations. The study also concluded that the available protection for the detainees and prisoners in the occupation prisons is inadequate, and doesn't provide the minimum of the rights approved in the international agreements.The researcher provided a number of recommendations at the end of the study. These recommendations ask the Palestinian Authority to ask the International Court of Justice to get a legal judgment about the legal situation and characterization of the female detainees and prisoners in the Israeli occupation prisons. This procedures aims to end the legal disagreement about their characterization. The researcher also recommended to ask the international committee of the Red Cross for increasing its effect and controlling role in the Palestinian lands and to exert real pressure on the Israeli authority to compel it to apply the agreements of Geneva in the Palestinian female detainees and prisoners.
