- Transitional Justice provides a shift (a transformation) from an authoritarian regime to a democratic system that respects human rights. The stated goals of Transitional Justice are to support changes at the level of institutions in order to allow the prevalence of the rule of law, build trust between warring groups, and restore dignity to victims. The study "Transitional Justice and Societal Reconciliation after (2003)" aims to identify the current status of transitional justice and societal reconciliation after (2003) and to pinpoint the causes and effects which may be rise due to the delay in implementing transitional justice. The researcher uses four scientific approaches: “the descriptive approach, the historical approach, the field surveyapproach, and the comparative approach”, and the study tests (8) hypotheses to test their credibility, and Al-Kut city was chosen to be a community of study. The study sample consists of (475) intentionally chosen respondents. The study comprises two aspects: theoretical and fieldwork (practical). Each aspect consists of several chapters, as well as an introduction. The theoretical part consists of three chapters: Chapter One presents the problem, importance and objectives of the study, and is concerned with defining the basic concepts and terms used in the study. Chapter Two is concerned with reviewing previous studies close to or similar to the current study, in addition to gaining familiarity to the experiences of a number of nations in terms of transitional justice and societal reconciliation. As for Chapter Three, it is concerned with finding out the reality of transitional justice and societal reconciliation after (2003) and the mechanisms for their implementation. The Chapter Four studies the causes and effects resulting from the delay in implementing transitional justice and societal reconciliation. The fieldwork part of the thesis comprises the Chapter Five, which represents the methodological framework as well as testing the hypotheses to ensure their validity and credibility. Chapter Six analyzes the individual data of the respondents. Chapter Seven is concerned with analyzing and interpreting the results of the field study of the reality of transitional justice and societal reconciliation in Iraq after the year (2003). Chapter Eight analyzes and explains the causes and effects of the delay in implementing transitional justice and societal reconciliation in Iraq after (2003). Finally, Chapter Nine discusses the study hypotheses, results, and recommendations. ..............................................................................................................Abstract178Among the results of the study:1.Transitional justice cannot be achieved unless the state takes upon itself to achieve the independence and integrity of the judiciary system and punishing the perpetrators and the corrupt.2.Electing an honest and competent political class which is capable to properly and comprehensively implement the mechanisms of Transitional Justice, and which takes upon itself to achieve a stable and secure environment in which the members enjoy their full rights in health, service and education.3.Transitional Justice contributes to preserving the entity of the state and the permanence of its institutions. It is not a substitute for Criminal Justice, but rather an exceptional justice for a transitional period.4.Transitional Justice cannot achieve its goals without achieving its integrated mechanisms (criminal accountability, institutional reform, prosecutions, truth-seeking, and compensation).5.Through the successful experiences of some of the aforementioned countries that have undergone a democratic transition, it becomes clear to us that stability and peace prevailed in them and did not take a path to development except with true Transitional Justice, as all energies and capabilities were harnessed, efforts were intensified and all parties got involved in achieving transitional justice, In contrast to what exists in Iraq, where there is divisions, conflicts, and sub-sectarian loyalties.
