ترجمة الملخص

This thesis discusses burglary crime under Jordanian penalty law whereas the Jordanian penalty legislator didn’t specify a fixed penalty for burglary crime but it decreed different punishments per conditions related to crime committed. Burglary is a simple crime legal – wise but due to the conditions that accompany it becomes a stressed misdemeanor that its doer is punished by three years in jail, but if it conditions are too much dangerous, then it will be specified as a crime. Due to stressed conditions that may accompany it, the penalty legislator specified it as a crime and due to that hardened the penalty against its doer. I shall limit my study just on the crime provided for in Art (400) of the Jordanian penalty law (burglary) which provides that the doer shall be punished by hard labor imprisonment either temporary or for life time as follows: 1-The one that takes place at night. 2-The one committed by two persons or more. 3-The one where the thieves holds weapon either apparently or non apparent. 4-To enter a house or its annexes by destroying its walls or else. 5-That the thieves or one of them threatens by weapon or alike harshly one of the house people in committing the or executing it or to make doers leave place smoothly or take hold of the items stolen. The Jordanian legislator provided that five hard conditions have to be present for burglary hard penalty or temporary one not less than (15) years jail. Because thesis subject in section two handled burglary crime and alike or annexes showing the type of the five conditions combined that stress penalty. Recommendations: The researcher due to the foregoing state here the results & his view points as follows: In our Jordanian legislature there are many positives related to research subject, there is, as I see, a legal short coming that needs review by Jordanian legislator.
