Verily, the practice of any sort of tobs is abided by special law, for affecting every individual's right. that doesn’t mean without any limits or restriction, one may sell drugs or herbals and cause problems to others, that's why, law was put to regulate the manner of those who sells medical drugs or herbals and to make them realize their responsibility according to others. Because of the deficiency of having text in law relate to those professions like pharmacist ,physician ,doctors….. Etc, it was necessary to put rules for them with their duties and obedience to restrict(define)the problem, the selling of medical drugs of grass herbals must do buy by pharmacist according to the law of profession of Iraqi pharmacology. But on the other side, what is the real situation or factual processing of selling those materials in Iraq? Is there correspondency between the theoretical aspect and practical aspect? If the answer is negative, so what are the problems that load to this chaos? What are the topics that are raised during the studying of how to sell the medical drugs? Does the term (drugs) include artificial ones or include in addition to that, the herbals also because it is drugs too? What is the situation of comparative laws to the inclusion of term (drug) for grass herbal medicine? Or can we interpret the term (drug) to an extent that the non-natural drugs include the herbal medicine also for the thesis? For extent was the Iraqi legislator successful in non- mentioning of herbal medicine by clear texts? So, what is the reason of existing non-specialized people in the public streets who sell drugs? Is it inadequacy by the special security to prevent such a sale or people willingness to buy from that restrictive group because of illiteracy of people? or both are responsible of this catastrophy?all these question we will try to put suitable, sufficient answer of each .also the lack of lawful libraries in Iraq ,and the absence of the researches of civil responsibility of such sale ,from other hands the motivations that en courage me to arrange the thesis is the in sufficient and gaps that are available in regulated texts of law for drug s sale ,among them the law of Iraqi pharmacist profession ,and the most permanent lack is non –discussion of herbal medicine cases by free text…the importance of our thesis is connection between the law and pharmacology with the modern communicative technology like internet through the elaboration of the meaning of drugs and definition of herbal medicine and the fields of differences for each and their sources, with the danger that accompanies each one of them if they used falsely .also explaining the procedures of selling drugs on internet ….the significance of this connection for the men of law generally and judges particularly to have the total information to deal with the affairs in the appropriative ways and to all non-specialized people from societies to awake their health attentions to realize the affects of misusing drugs .also the thesis deals with anew topic which is the selling of drugs through internets and showing the lawful problems that caused by this shape of sale ,and the ways to resist them in order that the scientific and technical development of modern communicative might be progressed better .we have chosen the style of comparative analysis so as to shed light on the various cases of law of Iraqi pharmacists profession and other comparative laws ,clarifying the powerful and feeble points of each texts . the thesis plan consists of three chapters in addition to introduction ,in the preface we define the drugs and the herbal medicine ,the first chapter is devoted to the sale of drugs by the formal sellers and non-permitive people ,also selling drugs through the internets …..the second chapter studies the civil responsibilities as a result of selling drugs and herbals by it is different kinds .the last chapter discusses the achievement of civil responsibilities from the drugs sale with the pair judges for each condition .the summary composed of the thesis conclusions and the suggestions, the solutions that we came out with.we hope that we achieved the purpose of our thesis ,by the help of God,we did our best to fulfil the wished tasks .and reasonable results.
