ترجمة الملخص

This study discusses the civil protection of computer programs as a comparative study among the Jordanian legislation, the Egyptian legislation and other Arab ones as well as jurisprudence’s point of view in this kind of protection according to the copyright protection I noticed through this study that there are different trends to protect the computer programs. The first trend is providing protection for these programs under the law of copyright protection which has two sides; the first is to submit computer programs under the copyright protection and whereas the second is the Judicial and legislative opinion. However, the second trend is protecting computer programs among the international law that has two aspects; the first protecting computer programs through international organizations, and the second aspect is: the protection of computer programs through international conventions. There is a tendency which only contends traditional texts for such protection, where some government departments have adopted the appropriate implementation of copyright laws in this direction. However, most countries are moving to amend their existing legislation to include computer programs.The attitude of Jordanian legislator has been with no response for along time till voices got risen calling for a law protecting copyright till Act No. (22) of copyright protection for the year (1992) was issued for the protection of literary works including the protection of computer programs explicitly in Article 3 and in the second paragraph of the eighth of this paragraph This study aims to state the reality of civil protection for computer programs through legal texts for such protection and the ability of this legislation to provide and ensure an adequate and comprehensive protection for these programs.It also aims to clarify the position of international law in this protection and its principles of development as well as the role of international organizations and conventions including the Arab legislation, particularly the Jordanian legislator’s to gain access to the scientific application of the proper judicial. This research includes one chapter in which I show what the computer programs are and its protections methods. In the second chapter, I show the protection of computer programs through international law where you through this stating protection for these programs through international organizations particularly, the World Intellectual Property Organization (WIPO) and the Organization of the United Nations Educational, Scientific and Cultural Organization (UNESCO).I also clarify this protection through international conventions such as: 1- Berne Convention for the Protection of Literary and Artistic Works2- TRIPS trade-related aspects of intellectual property rights.
