الملخص

لقد اتفق كل من الفقه و القضاء على إعطاء تعريف موحد لعقد الأشغال العامة بأنه ذلك العقد الذي ينصب موضوعه على إنجاز أشغال البناء أو الهندسة المدنية بناء على طلب أحد الأشخاص العامة التي تمارس سلطة صاحبة المشروع،و بتالي فإن عقد الأشغال العامة هو اتفاق مكتوب يبرم بين الإدارة و إحدى الهيئات العمومية المنصوص عليها في نص المادة 2 من المرسوم الرئاسي 10/236 المعدل والمتمم، و يكتسي عقد الأشغال العامة أهمية خاصة بالنظر إلى حجم الغلاف المالي المخصص لقطاع الأشغال العمومية و أهمية في وضع البنية التحتية للاقتصاد الوطني لذلك وضع المشرع الجزائري مجموعة من النصوص القانونية التي تنص صراحة على أساليب محددة لإجراء العقد و لاختيار المتعاقد و هي الأساليب التي سعى من خلالها بفرض نظام الرقابة على عقد الأشغال العامة و ذلك للتأكد من حسن صرف الأموال العامة، و رغم هذا لم يخلو عقد الأشغال العامة من نشؤ مجموعة من المنازعات من شأنها أن تؤدي إلى المساس بحقوق الأطراف المتعاقدة إلا أن المشرع تدخل لضمان حقوق الأطراف و بين أطر تسوية تلك المنازعات سواء بالاعتماد على الحل الودي أو اللجوء إلى القضاء.
