Civil-Military Relations in Sudan: A Constitutional Perspective

الملخص

This thesis explores the constitutional dynamics of civil-military relations in Sudan, particularly the relationship between the existence of constitutional provisions regulating the role of the military and the level of civilian control. The thesis argues that the absence of constitutional provisions regulating the military in Sudan’s constitutions is a result of a deliberate and continuous effort of the military to maintain its institutional privileges. The thesis contends that in Sudan, the historical evolution of the military resulted in an autonomous and independent military institution, that is not confined by the rules of conventional civil-military relations, which resulted in institutional privileges for the military. The analysis in this thesis reveals how Sudan’s military has evolved into a major political actor, with entrenched privileges that have been both created and sustained through constitutional mechanisms. In constitutional terms these privileges have been translated in the non-regulation of the military. Moreover, the thesis constructs a theoretical framework composed of the concepts of constitutional second-best, path dependency, and the institutional priority to build the main argument which contends that a stable constitutional arrangement in Sudan must explicitly recognize the military as a constitutional actor, while simultaneously detailing and constraining its role. Such arrangement while not eliminating the military as a political actor, must keep in mind limiting the military’s constitutional privileges that are a result of a long history of institutional entrenchment, which can be achieved by creating constitutional rules defining hierarchal structures of government ensuring a strong presence of civilians at the top of these structures.
