الملخص

RESUME :La création de conseils constitutionnels est une réponse au développement l'une des techniques de constitutionnalisme, qui est la justice constitutionnelle. Ainsi mise en place du conseil constitutionnel en Algérie s'inscrit dans le même contexte, qui incarne cette justice par deux fonctions constitutionnelles : La première, comme un juge des contentieux électoraux, et la seconde par le contrôle constitutionnel. Et les expériences de comparaisons sont prouvées la capacité du parlement à l'arbitraire et le despotisme sur d'autres autorités dans le système politique, de sorte que le conseil constitutionnel a utilisé son jurisprudence constitutionnelle - le contrôle constitutionnel - pour l'influencer sur le travail parlementaire, des deux côtés ; la politique et normative ;Mais la question de la prestation de cette influence dans améliorer l'exécution des travaux parlementaires ; politiques et normatifs, au lieu de l'affaiblir au bénéfice le reste des institutions constitutionnelles, requiere examine certaines des bases de travail du Conseil constitutionnel lui-même, afin d'éviter le spectre des juges du gouvernement.ABSTRACT :The establishment of constitutional councils comes to response the development one of the constitutionalism techniques, which is the constitutional justice. well establishment of the Constitutional Council in Algeria comes in the same context. Who embodies this justice by two constitutional functions: the first one, it as a judge of the electoral disputes, while it achieves the second function by the constitutional control. And the comparison experiments has proved the capability of parliament to the arbitrariness and despotism on other authorities in the political system, so the constitutional council used his second function - the constitutional control - to influence the parliamentary work, on both sides; the political and normative;while the issue of benefit from this influence in improve the performance of the parliamentary works; political and normative, instead of weakening it in face the rest of the constitutional institutions, requires reviewing some of the work foundations of the constitutional council itself, to avoid the specter of Government judges.
