ترجمة الملخص

The purpose of the study collect, extract and study the choices of Al-Hakim Al-Shaheed in the issues marriage and divorce, and then study and compare these issues to reach the most correct opinion on each issue. To conclude the findings of this study, the researcher used the inductive and deductive method to reach the choices of choices of Al-Hakim Al-Shaheed in the selected issues, and thenused the comparative method to clarify the choice of choices of Al-Hakim Al-Shaheed and compare it with the sayings of the jurists in the matter and reach the opinion returned according to the evidence. The study concluded that, the Imam al-Hakim -may God have mercy on him -agreed with the Hanafi in many issues, but he disagreed in some of them, such as: the invalidity of the marriage contract using the terms lease and will, and that the minimum dowry is not estimated as the Shafi’is and Hanbalis agreed in that, as well as Contrasted with the Hanafis on the issue of the occurrence of suspended divorce, as he took the Shafi’i school of thought.
