الملخص

أصبح انتشار جرائم الفساد يشكل خطرا على المال العام وتراجع ثقة المواطن في المؤسسات الإدارية ، مما فرض على المشرع الجزائري مكافحتها بقانون رقم 06-01 المتعلق بالوقاية من الفساد ومكافحته، والذي جاء بعدة بآليات لمكافحتها من أهمها التبليغ عن جرائم الفساد لمحاولة كشف المجرمين ، والذي عالجناه من خلال مفهومه، ثم من خلال الحماية الجنائية العامة والخاصة للمبلغ، وأيضا المسؤولية الجزائية للمبلغ وتوصلنا إلى عدم وجود قانون خاص بحماية المبلغ، وعدم توفير حماية إجرائية خاصة للمبلغ، وتوفير حماية جنائية موضوعية لكنها غير كافية . ترجمة الملخص

The proliferation of corruption crimes poses a significant threat to public funds and erodes citizen trust in administrative institutions. In response, the Algerian legislator has enacted Law No. 06-01 on the prevention and combating of corruption, which introduces various mechanisms to combat corruption, including the reporting of corruption crimes. This study examines the concept of reporting corruption crimes, the general and specific criminal protection afforded to reporters, and the criminal liability of reporters. Our findings indicate that there is a lack of specific legislation protecting reporters, inadequate procedural protection, and insufficient criminal protection. (La propagation des crimes de corruption constitue une menace pour les fonds publics et entraîne une perte de confiance des citoyens dans les institutions administratives. Le législateur algérien a adopté la loi n° 06-01 relative à la prévention et à la lutte contre la corruption pour combat trece phénomène. Cette loi prévoit plusieurs mécanismes, notamment la dénonciation des crimes de corruption, pour tenter de démasquer les criminels. Nous avons étudié ce sujet sous l'angle du concept de dénonciation, de la protection pénale générale et spéciale du dénonciateur, ainsi que de la responsibility pénale du dénonciateur. Nous avons concluq u'iln'existe pas de loi spécifique pour protéger le dénonciateur, qu'i ln'y a pas de protection procédurale spéciale et que la protection pénale est insuffisante
