This thesis deals withthe Legal value of illegally obtained evidence of proof in criminal proceedings, in both Syrian and American legislations. Thesubject research requiredremedyatrootingproblem ofevidenceobtained ofillegal waysin the first chapter, and solutions to this problem in the second chapter.The first chapter,dealswithScrutinydiscussesthe jurisprudence, legislative and judicial positions of the evidence obtained by illegal means manual, and the reliability of the conviction of the accused.The second chapter, deals with the solutions presented were approved by the judiciary, as an alternative either to total or part, to exclude evidence obtained from illegal ways, and the analysis and extrapolation of those solutions in the legal texts, and the seriousness of their application in practice.Finally, the research has concluded a number of results and recommendations that help of adoption plan legislativeto evidence obtained ofillegal waysremedy; throughestablishing a general principle of exclusion evidence obtained illegally, with exceptions to that principle to justify the acceptance of such evidence based on a combination of factors and considerations.
