:les contrats d'investissement International sont considéré comme les plus importants contrats conclus par l'Etat dans le cadre de son développement à travers les différents domaines qui interfèrent avec la gestion et l'organisation de ces derniers, et le fait que ces contrats impliquent d'énormes ressources financières et des qualifications techniques particulières sans mentionner la durée de sa mise en œuvre, ces contrats peuvent rencontrez quelques problèmes . Certains des problèmes varient vis a vis de la vision des parties inclus à la question. D'autre part, l'imposition de l'autorité de l'Etat par l'application de sa législation nationale en tant que partie avec des privilèges publique et qui tient à l'intérêt public. Alors pour réduire ces difficultés La volonté des parties joue un rôle très important dans la mise on œuvre de certaines conditions contractuelles comme la prévention des conflits ou le choix des moyens par les quels le règlement du conflit qu'il soit ou non soumis à procès.Summary:International investment contracts are among the most important ones concluded by the state, in the context of developing them in many respects being part of their management and organization. Having these contracts involving gorgeous financial resources and specific technical qualifications along with their long term execution, they make take some various forms with regard to parties’ vision towards the issue. On another hand, having state imposing its power as a party of public authority privileges, being eagerly caring about public interest. In order to end such conflicting forms, the Will plays a key role dedicating some contractual terms by which conflicts are settled or choosing the fitting in way to settle the conflict, being by arbitration means or not
