الملخص

مستخلص الدراسةيهدف هذا البحث لبيان دور الرقابة الشرعية في ضبط أعمال المصارف الإسلامية ولأهمية الرقابة الشرعية التي تطبق على البنوك والمؤسسات المالية الإسلامية، ومدى شفافية ذلك وتأتي (أهمية البحث) هي أن الرقابة الشرعية إحدى أسس النظام الصرفي الإسلامي وكذلك إحدى عناصر التميز عن نظام المصارف التقليدية وضرورة وجود هيئة شرعية للإفتاء فيما يعرض للإدارات البنك تتطلب معرفة الحكم الشرعي مع التزام المصارف الإسلامية بالشريعة الإسلامية تحقيق أهدافها . وتوضح مشكلة البحث فى الرقابة الشرعية ودورها فى ربط اعمال المصارف الاسلامية والمعايير التنفيذية لعمل هيئة الرقابة الشرعية. اما فرضيات البحث فى الرقابة الشرعية ومدى تنفيذها على صيغ المعاملات المالية والمصرفية للبنوك الاسلامية وأيضاً فى اختيار اعضاء الهيئة وتعيين المراقب الشرعى. ضرورة وجود قانون للرقابة الشرعية ينظم اعمال الرقابة الشرعية ويضع الآليات المناسبة لمراقبة هيئة الرقابة الشرعية وايضاً وجود هيئة عليا للرقابة على المؤسسات وتضم الهيئة مجموعة من علماء الشريعة المختصين فى المعاملات المالية وتدريب وتثقيف العاملين فى المؤسسة المالية بالمفاهيم والضوابط الشرعية وايضاً انشاء جهاز للرقابة الداخلية وتزويدهم بعدد كاف من المراقبين.AbstractThis research aims to demonstrate the role of the Sharia Supervisory Board in controlling the work of Islamic banks and the importance of legitimate oversight that apply to Islamic banks and financial institutions, and the transparency that comes (the importance of research) is that the Sharia Supervisory one of the foundations of the Islamic morphological system, as well as one of the elements of excellence for traditional banking system and the need for a Shariah Board for Issuing with displays departments Bank requires knowledge of the legitimate government with Islamic banks commitment to Islamic law to achieve its goals. And describes the research problem in the Shari'a and its role in linking the Islamic banks and standards for executive action Sharia Supervisory Board. The research hypotheses in the Shari'a and the extent of implementation of the financial and banking transactions for Islamic banks formats and also in the selection of board members and the appointment of the observer legitimate. The need for a law Sharia regulates acts of legitimate oversight and put the appropriate mechanisms to monitor the Sharia Supervisory Board and also the existence of a supreme body for the control of institutions, including the Commission a group of specialists Sharia scholars in the financial, training and education of personnel transactions in the financial institution concepts and controls legitimacy and also set up a device for internal control and provide them with an adequate number observers.
