الملخص

إن القواعد الأصولية والفقهية هي المفتاح الأساسي لحل الكثير من التعقيدات في المسائل التي أشكلت على الكثير من الناس سواء أكانوا علماء أو متعلمين أو عاملين ، حيث إن القواعد الأصولية الفقهية تضع أسسا إستنباطية للأحكام الشرعية من الأدلة التفصيلية ، ومن أهم المسائل والقضايا التي يتداولها الناس في حياتهم المعاملات المالية والتي تجد فيها عدة شكلات سواء أكان في التجارة أو غيرها فقد جاءت تلك الأحكام الشرعية لتوضح وتفصل ما أشكل علي الناس في الأمور المالية. هدقت الدراسة إلي ابراز أهمية القواعد الأصولية والفقهية في علاج المشكلات التي تتعلق بالمعاملات إلمالية, معرفة المسائل المستجدة في المعاملة المالية والحكم عليها وفقا للقوائد الأصولية والفقهية . اتبعت الدراسة المنهج الوصفي الاستقرائي والمنهج التحليلي . توصلت الدراسة الي عدد نتائج من أهمية : إن العلاقة القواعد الأصولية علاقة تلازمية إذ يصعب علي الفقيه أو المجتهد والوصول إلي حكم إلا من خلال القاعدة الأصولية الكلية المنستنيطة من الأحكام الشرعية , وقد بيتت تلك القواعد وساعدت المجامع الفقهية في إصدار الفتاوي فس المسائل التي تتعلق بالمعاملات المالية ,مما ساعد علي حل المشاكلات المصرقية المالية كالعقود التجارية وكيفية عملية الشراء بأنواع المختلفة مع بيان الحلال والحرام في تلك البيوع وأنواع عملات البيع من ذهب وفضة ونقود ورقية . وكيفية تبادل السلعة بالمال ,مع وجود علاقة تلازمية بين القواعد الأصولية والقواعد الفقهية , وأن لهذه القواعد الأصولية والفقهية القابلية التامة لحل كافة المشكلات المستجدة في باب المعاملات الملية في الإسلام وهذا يبين مدى استفادة القضاء والفقهاء والمجتهدين والمفتنيين في الإستعانة بها في أمورهم الملية وتداولاتهم لها . وهذا يؤكد شمولية القواعد الأصولية والفقهية في معالجة كافة المسائل التي تتعلق بالمعاملات الفقهية . توصى الدراسة بمعرفة الأحكام الشرعية التي تتعلق بالمعاملات المالية وبدراسات المعاملات المالية في البيوع الإسلام الشرعية , وبإطلاع العاملين علي المسائل الملية المتعلقة بعأمور التجارة , وبدراسة العلاقات المالية بين القؤاعد الأصولبة والفقهية لإثبات شمولية هذا الدين للمعاندين والمجاهدين . تقترح الدراسة إجراء المزيد من الدراسات التي تتعلق بالمواعد الأصولية والفقهية لمعرفة دورها في القضاية العقدية والمعانلات الملية , وبدراسة أراء العلماء الفقهية قيها يتعلق بالمعاملات الملية .

Fundamental and juristic rules represent basic solutions to many problems facing a number of people, whether they are scholars, students, or workers, because they function as deductive principles underlying elaborated juristic regulations. Among the most important questions commonly facing people in everyday life is the issue of financial transactions, such as trade, in which many problems arise. Those juristic regulations have been established to explain in detail and prescribe solutions to such financial questions. The study aimed at highlighting the important role of fundamental and juristic rules in solving problems of financial transactions, explaining the latest developments in such transactions, and passing judgment on such developments according to fundamental and juristic rules. The study has followed both the descriptive-inductive and analytical methods, and has arrived at several conclusions, the most important points of which are the following: Fundamental rules and juristic rules are concomitant with each other, as it is difficult for a jurist or a scholar of discretion to judge a case without basing his decision on a fundamental rule deduced from juristic rules. Fundamental and juristic rules have assisted bodies of jurists in stating advisory opinions on questions of financial transactions and in answering financial, banking questions, such as problems of commercial contracts and various types of sales and purchases. The rules also explain both lawful and unlawful dealings, the types of currency used in them such as gold, silver or paper currency, and the various methods of payment and exchange. In all such dealings, fundamental rules are concomitant with juristic ones, and both types of Islamic rules are capable of providing answers to various types of questions, including the latest developments in the realm of financial transactions; this shows how helpful these rules are for judges, jurists, and scholars of discretion and advisory opinions in passing judgment and making decisions on commercial, financial affairs. All the facts mentioned above prove that fundamental and juristic rules include comprehensive regulations capable of tackling all types of juristic, financial questions. The study has recommended undertaking studies on Islamic juristic regulations on financial transactions and sales; it has also recommended acquainting the people dealing with financial affairs like trade with those regulations, and doing studies on the financial relationship between fundamental rules and juristic rules in order to show to resisters and open opposers of Islam the comprehensiveness of the religion. The study has suggested further studies on fundamental and juristic rules in order to explain their role in financial transactions and contracts, and on jurists’ views on financial transactions.
