الملخص

تناولت في دراستي لموضوع الزواج العرفي وإشكالات إثباته في الشريعة وقانون الأسرة الجزائري ,حيث كانت إشكاليته متمثلة في مامشروعية الزواج العرفي؟وماهي أهم طرق إثباته؟وللإجابة عن هذه الإشكالية قسمت بحثي إلى أربعةمباحت تضمنت مفهوم الزواج العرفي من الناحية الشرعية والقانونية مع دكر حكمه الشرعي وأهم الأسباب التيأدت إلى انتشارة,وأهم الطرق التي يثبت بها وإجراءات تسجيله أمام الجهات القضائية وآثاره المترتبة على الأسرةخاصة والمجتمع عامة وفي الأخير دكرت خاتمة تضمنت أهم ماتوصلت إليه ان الزواج العرفي المستوفي لأركانه وشروطهزواج شرعي صحيح ينقصه التوثيق أمام الجهات القضائية فقط.

In my study of the subject "Customary Marriage and the Problems of Proving It in Sharia and Algerian Family Law," the thesis statement and its primary research questions were formulated as follows: "What is the legality of customary marriage, and what are the most important methods of proving it?" The topic was divided into four main axes: The concept of customary marriage from both the Sharia (Islamic Law) and legal perspectives. The most important reasons that have led to its widespread prevalence. The procedures for its registration and validation before the judicial authorities. Its social and familial effects on the family and society. As a conclusion, the study reached several key findings, most notably that a customary marriage which meets all its essential pillars and conditions is a valid and legitimate marriage, lacking only formal documentation and registration before the judicial authorities.
