الملخص

يعد تنفيذ حكم التحكيم أهم مرحلة من مراحل العملية االتحكيمية برمتها، فبصدور حكم التحكيم يفترض تنفيذه من قبل الأطراف بالطريقة الودية، إلا أنه يمكن لأحد الأطراف أن يتقاعس في تنفيذ حكم التحكيم، مما يجعل الطرف الآخر يلجأ الى التنفيذ الجبري عن طريق طلب يتقدم به الى الجهة القضائية المختصة بإتباع نظام رفع دعوى قضائية أو نظام الأمر بالتنفيذ وإتباع الإجراءات المنصوص عليها قانونا، ليقوم القاضي بعد ذلك ببسط رقابته على حكم التحكيم والتأكد من وجود الحكم وعدم مخالفته للنظام العام،ومن ثم إصدار حكمه سواء بقبول الطلب أو رفضه، وصولا الى مرحلة الطعن في قرار القاضي من قبل الطرف الذي يهمه الأمر.
