الملخص

ان شرط ثبات التشريع يعد ضمانة ذات أهمية كبيرة للمستثمر الأجنبي ،التي تعمل على تشجيعه لتوظيف أمواله ومشاريعه الاستثمارية، غير أن عقود الاستثمار التي تبرم بين الطرفين غير المتساويين (الدولة المضيفة ،المستثمر الأجنبي )،أما الدولة فهي شخص من أشخاص القانون الدولي العام وبالتالي تتمتع بالسلطة والسيادة التي تخولها التعديل أو الالغاء بتشريعاتها الداخلية بصفة انفرادية ،وذلك تحقيقا للمنفعة العامة .في حين يمثل المستثمر الأجنبي شخصا خاصا يخضع للقانون الداخلي ،فهو الطرف الضعيف في العلاقة التعاقدية، مما يؤدي الى بالطرفين من أجل حل النزاع الى التحكيم الدولي أو عقد صلح ...، وفي ظل عولمة الاقتصاد وتوحيد القواعد الدولية المطبقة على الاستثمارات، وبالخصوص في مجال الحماية والضمانات تسعى الدول ومن بينها الجزائر الى تكريس شرط الثبات التشريعي على اعتباره ضمانة قوية من أجل جلب الاستثمارات الخارجية ورؤوس الأموال من أجل تحقيق التنمية ونقل التكنولوجيا والخبرات.
