الملخص

حثت هذه الرسالة ي الأحكام الفقهية المستفادة والمستخلصة من صحيح أخبار الأنبياء ي الكتب الستة، وقد قسمت فصولها ومباحثها بحسب تقسيمات الفقهاء لها؛ فابتدأتها بفصل العبادات وختمتها بفصل الآداب والفضائل.َأاهميسقتلبقوْثَبُتحجية شرع من قبلنا ي النوع الذي وقع فيه خلاف الفقهاء، وذكرت أهمية وفوائد ما ورد ي نصوص الكتاب والسنة من صحيح أخبار الأنبياء.وأما الأحكامالفقهيةالمستفادة من صحيح أخبار الأنبياء ي الكتب الستة التي رتبتها تبعا لأبوابها فإني جعلت كل مسألةي فرعين أو مطلبين بحسب التنسيق الموجود؛ ففي الأول صورت المسألة وبينت الأحاديث المشتملة على أخبار الأنبياء، أما ي الثاني فقد بينت الأحكام الواردة ي الأحاديث كشرع منقبلنا وحكم ذلك ي شريعتنا .وقد وضحت ي كل مسألة بحثتها مدى موافقتها ومخالفتها لشرع من قبلنا، ومن أي زاوية كان ذلك.وأما حكم المسألة ي شرعنا فإني بحثته بحثا مقارنا؛ فذكرت اتفاق العلماء فيما اتفقوا عليه،وي مواطن اختلافهم ذكرت أدلة كل فريق منهم وناقشتها وبينت الراجح منها، ثمقارنته بشرع من قبلنا إن كان موافقا أم مخالفا.دافتسلماىرخلأافئاطللاضعبىلعتجّرعوة من المسائل المذكورة. ‌هواتبعت ي الرسالة المنهج الوصفي الاستقرائي، إضافة إلى المنهج الاستنباطي، مع مراعاة قواعد وأسس البحث العلمي ،وثقت المنقول إلى أصله و نسبت الأقوال إلى أصحابها وعزوت الآيات إلى سورها ّرخكلذكوجت الأحاديث الواردة فيها، وترجمت للأعلام، ووضحت غريب الحديثومفرداته.وي نهاية رسالتي توصلت إلى نتائج من أهمها :أن الكتب الستة تزخر بالأحكام الوارد ذكرها ي شرع من قبلنا ما بين موافق ومخالف لشرعنا.ومن الأحكام التي توصلت إليها ي رسالتي أنها ي شرع من قبلنا، أصول العبادات كالصلاة والصيام والحج والصدقة وهي موافقة لشرعنا، ومن الأحكام التفصيلية التستر عند الغسل والنظر إلى العورات فهي مما خالف شرعهم شرعنا، وكذا لبس المخيط للمحرم وحرق النمل، ومما وافقهم من الأحكام التفصيلية الوضوء والالتفات ي الصلاة والإشارة فيها وكذا صيام عاشوراء وصفة صيام التطوع والتلبية ي الحج، وجواز استخدام الحيل ي القضاء، وتحريم الغلولومثل ذلك حكم ابتداء السلام ورده.ومن التوصيات كذلك أن يسلك هذا الطريق طلاب العلم ليمحصوا عن تلك الأحكام لما لها من أهمية؛ فشرع من قبلنا حجةودليلمؤيد لباقي الأدلة ي المسائل المذكروة عند أصحاب أحد المذاهب ي كل مسألة، ناهيك عن المسائل التي كان فيها شرع من قبلنا محل اختلاف الفقهاء، فكان حجة لهم ي حكمهم.وي النهاية لا أقول إلا ما قال إبراهيم وإسماعيل عليهما السلام :،ءاعدلاعيسمكنإاّنملبقتانبروله الحمد سبحانه ي الأولى والآخرة حمدا يليق بجلال وجهه وعظيم سلطانه، حمدا كثيرا طيبا مباركا فيه

ترجمة الملخص

This thesis investigates the jurisprudential rules learned from prophet true stories in the six books. The chapters of the thesis are organized following the approach of Islamic scholars, starting with the chapter of warships and ending with the chapter of good manners and virtues.Before grouping jurisprudential rules into chapters, I proved the validity of referring to previous prophets doctrines in the issues that scholars did not agree upon. I also mentioned the significance of prophet stories referred to in the Noble Quran and Sunnah.Each chapter of the jurisprudential rules learned from prophet true stories in the Six Books is divided into two parts: the first explains the issue under discussion and includes Prophet Mohammad’s –peace be upon him –sayings about previous prophet stories, while the second discusses the jurisprudential rules concluded from our religion and those concluding from previous prophets stories. How much these two types of jurisprudential rules agree is also highlighted.I followed a comparative approach for issues referred to in our religion. I mentioned the issues that scholars agreed upon as well as the proofs of each scholar regarding the issues they disagreed upon. I illustrated their proofs and compared them with those learned from prophet stories.Some other witticisms are also pointed out in this thesis. Both the inductive descriptive approach as well as the deductive approach are followed in the present thesis taking into account the principles of the scientific research. All references are appropriately cited, the Surahs (chapters) of the verses are referred to, the validity of Prophet Mohammad –peace be upon him -Sayings is ‌زpointed out, the scholars’ biographies are brieflyillustrated, and the difficult words are explained.One of the most important recommendations of the thesis is that the Six Books are rich in the rules found in the prophets stories, whether they agree each our doctrine or not.Amongst the rules concludedin the thesis that are the same in the Islamic doctrine and the previous prophets’ doctrines are the worships such as prayers, fast, pilgrimage, and alms (Zakat). However, these two doctrines disagre in regard to some detailed rules, such as covering while ablution (wodu’), looking at what should be concealed of adornment, wearing sewn clothes for pilgrimages, and burning ants. Yet, the doctrines agree on some detailed rule, like ablution, making gestures during praying, fasting Ashura, voluntary fasting, raising the voice during pilgrimage, and using tricks in judiciary.The thesis also recommends hard-working students to investigate those rules due to their significance. The doctrine of previous prophets could be a supporting proof for scholars in issuesdisagreed upon. At the end, I have nothing to say but I quote what Abraham and Ishmael –peace be upon them -said; ”Our Lord, accept this from us. Indeed You are the Hearer of supplication.“ All praise is due to Allah
