الملخص
Intellectual property rights are limited territorially because theyexist and are exercised within the jurisdiction of the country or countriesunder whose laws they are granted. The extent of protection andenforcement of these rights varies a great deal around the world and asintellectual property is becoming more important in trade, this variationin the protection of intellectual property becomes a source of tension ininternational economic relations. The TRIPS Agreement tries to controlthe way these rights are protected around the world by bringing themunder common international rules so much so that trade disputes overintellectual property rights are resolved under the WTO’s disputesettlement system. The wise decision to join the World Trade Organization currentlyunderway in Sudan has made it necessary to focus some attention to thisbranch of law in Sudan at this point in time. This thesis attempts to find out whether or not Sudan law ofintellectual property conforms with the international standards set out inthe TRIPS Agreement. The thesis is divided into four chapters. ChapterOne discusses diplomatic and judicial settlement procedures laid down bythe United Nations Charter. The chapter explains how this methods haveproved their practical usefulness to the extend that they have beenadopted as the most suitable and ideal methods for resolving disputes notonly between the member states of the United Nations but betweenmember states parties to many other international organizations as well, including the WTO.Chapter Two discusses the DSU’s three stages of resolving a tradedispute within the WTO’s framework, and how effective this system I asshown by the volume of cases submitted to it including cases which arisefrom the TRIPS Agreement.Chapter Three deals with enforcement of intellectual propertyrights. It compares criminal and civil remedies laid down in the TRIPSAgreement with their corresponding remedies provided under theSudanese laws.Chapter Four summarises the thesis and reaches a conclusion thatthe Sudan legal regime is reasonably in compliance with the norms andstandards of TRIPS Agreement and gives a few suggestions in form ofrecommendations which if adopted could fill the gaps that exist atpresent.
