الملخص

يتناول هذا البحث الالتزامات القانونية المفروضة على نشاطات البحث والاستغلال في قطاع المحروقات في الجزائر في ظل القانون 19-13، من خلال تحليل مضمونها وتصنيفها، ثم دراسة الجزاءات المترتبة عن مخالفتها. حيث ركز على الالتزام بدفع الجباية البترولية باعتبارها مورداً أساسياً لتمويل الدولة، والالتزام بحماية البيئة نظراً للمخاطر المرتبطة بالنشاطات النفطية. كما تطرق إلى الإطار المؤسسي المتمثل في وكالتي المحروقات ودورهما الرقابي والعقابي، إضافة إلى العقوبات المالية وغير المالية. ويهدف البحث إلى إبراز التوازن بين تشجيع الاستثمار وحماية السيادة الاقتصادية والبيئية للدولة.

Cette recherche aborde les obligations légales imposées aux activités de recherche et d’exploitation dans le secteur des hydrocarbures en Algérie en vertu de la loi 19-13, en analysant et en classant leur contenu, puis en étudiant les sanctions résultant de leur violation. Il s’est concentré sur l’engagement de payer la taxe pétrolière en tant que ressource essentielle pour le financement de l’État, et l’engagement à protéger l’environnement compte tenu des risques associés aux activités pétrolières. Il a également évoqué le cadre institutionnel représenté par les deux agences pétrolières et leur rôle de supervision et de sanction, en plus des sanctions financières et non financières. La recherche vise à mettre en évidence l’équilibre entre encourager les investissements et protéger la souveraineté économique et environnementale du pays. (This research addresses the legal obligations imposed on research and exploitation activities in the hydrocarbon sector in Algeria under Law 19-13, by analyzing and classifying their content, and then studying the penalties resulting from violating them. He focused on the commitment to pay the petroleum tax as an essential resource for state financing, and the commitment to protecting the environment in view of the risks associated with oil activities. He also touched on the institutional framework represented by the two fuel agencies and their supervisory and punitive role, in addition to financial and non-financial sanctions. The research aims to highlight the balance between encouraging investment and protecting the country's economic and environmental sovereignty)
