الملخص

إن سلطة الإدارة في المحافظة على الذوق العام جزءًا أساسيًا من المحافظة على النظام العام كصيانة المجتمع من الاعتداءات التي تُصيب النظام العام في كافة النواحي، بوصفه اعتداءً معنويًا يتمثّل في انتهاكٍ في المجتمع الذي يُقيِّد حرمة أمور عديدة، مما يعكس المنتهك في سلوكيات غير لائقة تُحدث انطباعات خاطئة في قلوب العامة تجاهه، كمؤشرٍ واضحٍ في كل درجات الاستقرار الأمني الاقتصادي للمجتمع، لما يصدر من المعتدي فيكون واضحًا كالشمس في المجتمعات، كما يسبب مشكلات لا حدّ لها. تتجلى هنا وظيفة سلطة الضبط الإداري التي تمارسها فِقْه الإدارة العامة التي منحها المشرّع سلطاتٍ واسعة لكنها في الوقت نفسه مقيدة بحدود القانون وفقًا لمبدأ المشروعية. ومن مهام سلطة الضبط الإداري منع الإخلال بالنظام العام كالآداب العامة باتخاذ إجراءاتٍ وقائية تجنّب الإخلال والانحدار في القواعد العرفية غير المكتوبة، رغم افتقادها إلى الإلزامية المباشرة بوصفها مظهرًا من مظاهر الآداب العامة. يقع على عاتق المحافظة عليها العديد من الجهات المختصة بممارسة الضبط الإداري بمستوياته المركزية واللامركزية، إذ ليس كل عامٍ في الجهاز الإداري يقوم بمهمة الضبط الإداري، وإنما هيئات مختصة بالمحافظة على النظام العام، منها يشمل إقليم الدولة بأكمله ويمارس هذه المهمة الوزراء كالمختصين في نظام السلطة المركزية، بالإضافة إلى ما ينحصر في حدود الإقليم كجزء منه كالمحافظة فيتولى القائمون بالسلطة فيها المهام الضبطية باتخاذ كافة الإجراءات التي من شأنها أن تمنع الإخلال بالنظام العام. ومن اللامركزية أيضًا هيئات متخصصة كالشرطة لممارسة هذا الغرض، وتُستمد هذه المهام الضبطية من التشريعات القانونية الملزمة، كما تلجأ السلطات الإدارية للمحافظة على النظام العام إلى وسائل قانونية وقائية تمكنها من القيام بأعمالها بأدوات كالقرارات الإدارية والتنفيذ الجبري ضمن الحدود التي رسمها القانون، مع تقيد مهام الضبط الإداري بعدم المساس بالحريات العامة كالحق في الخضوع للرقابة القضائية وغير القضائية التي تكفل عدم انحراف الإدارة العامة عن الغايات المرجوة منها.

Time is limited by the law in accordance with the principle of legality.One of the tasks of the administrative control authority is to prevent violations of public taste and public morals by taking preventive measures to avoid violations of it because it descends from unwritten customary rules despite its lack of direct obligation as a manifestation of public morals.It is maintained by many bodies competent to exercise administrative control, some of which are central, as not every worker in the administrative apparatus carries out the task of administrative control, but rather bodies specialized in preserving public taste, some of which include the entire territory of the state, and this task is carried out by ministers and specialists from the men of the central authority.In addition to what is limited to the borders of a region or part of it, such as a governorate, those in charge of authority are responsible for controlling the tasks and taking all measures that would prevent breaches of public morals, including decentralized ones, in addition to specialized bodies and committees formed to exercise this purpose. These controlling tasks emerge from binding legal legislation, To preserve public taste, the administrative authorities resort to preventive legal means that enable them to carry out their duties to the fullest extent, which are administrative decisions and forced implementation., within the limits set by law, while adhering to administrative control tasks not to infringe on public freedoms and rights, and being subject to judicial and non-judicial oversight that ensures that public administration does not deviate from its desired goals
