الملخص

هدفت هذه الدراسة إلى تسليط الضوء على آفاق صحة التوقيع الإلكتروني في الإثبات، من خلال دراسة مقارنة للنصوص القانونية والتشريعات المختلفة التي تناولت الموضوع، عبر دراسة المشكلات التي يثيرها التوقيع الإلكتروني، وتحديد طبيعة هذا التوقيع، وطبيعته القانونية، والصور والأشكال التي يتخذها، والحماية المخصصة له في المعاملات الإلكترونية، والجوانب الأخرى المتعلقة بهذه الصحة. استندت الدراسة إلى الإجابة على الإشكالية المثارة، وهي طبيعة التوقيع الإلكتروني الذي يتميز بطبيعته غير الملموسة.يتطلب ذلك دراسة وتحليل مدى الانسجام والتوافق بين التوقيع اليدوي بمعناه التقليدي والتوقيع الإلكتروني بمعناه الحديث، حيث أن التوقيع في شكله التقليدي الذي يعتمد على وضعه في المستند الورقي المادي يثير العديد من المشكلات عند التعامل مع الوسائط الإلكترونية. تناولت هذه الدراسة الأحكام القضائية ومدى ملاءمة النصوص القانونية التي تناولت حجية التوقيع الإلكتروني في الإثبات.

This study aimed to shed light on the prospects for the authenticity of theelectronic signature in evidence, through a comparative study of the various legaltexts and legislation that dealt with the subject, by studying the problems raisedby the electronic signature, and identifying the nature of this signature, its legalnature, the images and forms it takes, the protection assigned to it in electronictransactions, and other aspects related to this authenticity. The study was basedon answering the problem raised, which is the nature of the electronic signature,which is characterized by its intangible nature.This requires studying and analyzing the degree of harmony andcompatibility between the handwritten signature in its traditional sense and theelectronic signature in its modern sense, as the signature in its traditional form,which depends on its placement in the physical paper document, raises manyproblems that occur when dealing with electronic media. This study addressedjudicial rulings and the suitability of legal texts that dealt with the authority ofthe electronic signature in evidence.This study concluded that electronic signatures and electronic documentsin general have become a reality that requires dealing with them, especially afterthe legislator gave them the necessary attention and entered the scope oflegislation in the majority of countries, including Arab countries. This opened theway for expansion of its application in electronic transactions and made thesubject of the electronic signature and document Electronic technology is animportant issue that no longer requires analysis and explanation of the reasonsfor accepting it or not. This study recommended several recommendations, themost prominent of which was the necessity of issuing a special law regulatingelectronic signatures, based on the ideas contained in the modern UNCITRALlaw, including the provisions it contains regulating this type of signatures.Key words: Validity, Electronic Signature, Evidence.
