ترجمة الملخص

The study dealt with the subject of penal protection for the privacy of medical profession through a study of the identity of medical work and the conditions for practicing it, for the purpose of identifying the individuals who are obliged to keep the secret and protect it. In the same time touching on the events that are considered confidential and should be kept as such with the commitment of not divulging them The study also considered the situations where these secrets may be divulged because of individuals or public interest. Finally, the study considered the penalty designated for the crime of divulging medical secret in the Libyan legislation and comparative legislations.The study relied upon the comparative for of answer to the questions and problems raised by the subject of the research, guided by some comparative legislations like the Egyptian, Jordanian and Emirates ones.The study reached conclusions and main recommendations:-1. The Libyan legislator calls for the issuance of laws or bylaws urging public and private hospitals, and all bodies, to put notices, inside the health institutions, stating that the patient has the right to protect his medical secret bylaw. Also, the legislator should put in place specific procedures for prosecuting those divulging the medical secrets, in a confidential situation in order to prevent the publicity of the medical secret of the patient.
