الملخص

المستخلص يتناول هذا البحث دراسة حماية حق فنانوا الأداء في ظل التشريعات الوطنية، ويهدف هذا البحث إلى تسليط الضوء على قانون حق المؤلف والحقوق المجاورة والمصنفات الأدبية والفنية لسنة 2013م, وما يحتاجه من إصلاح, كما يهدف إلى الوقوف على فنانوا الأداء بصورة تفصيلية وتوضيح حقوقهم.لتحقيق هذه الأهداف اتبعت الدراسة المنهج التحليلي الوصفي كدراسة مقارنة.ولقد تناول الباحث مفهوم حق المؤلف والحقوق المجاورة ، والتشريعات الوطنية المنظمة لحق المؤلف والحقوق المجاورة ، والاتفاقيات الدولية ، والحماية القانونية لفنانو الأداء. وفي ختام الدراسة توصل الباحث إلى مجموعة من النتائج أهمها : حق فنانوا الأداء ليس حق ملكية فحسب ، بل انه نوع خاص له طبيعة مزدوجة وينطوي على جانبين ، جانب أدبي ، وجانب مالي ولهذا يمكن النظر إلى هذا الحق على انه حق ادبي وحق مالي.ومن أهم التوصيات التي توصل إليها الباحث ضرورة نشر ثقافة حقوق فنانوا الأداء في المجتمع السوداني بكافة وسائل الاتصال, وإسناد إدارة الأجهزة المالية بإدارة الملكية الفكرية لجهات متخصصة بالسودان, على أن تتولى وزارة العدل الإشراف عليها وسن القوانين المنظمة لها وإنفاذها.The study discussed the protection of the right of literary performers under national legislation. The objective was to shed light on the Copyrights and Related Rights Law and the literary and artistic works of 2013 and the reform it requires. It also aims to identify the performance artists in details and clarifying their rights.to achieves these objectives, the study has followed descriptive analytical approach as a comparative study. the researcher discussed the concept of copyright and related rights, national legislation governing copyright and related rights, international conventions, and legal protection of performers .at the conclusion of the study has come out with a number of results, the most important of which is: The rights of performance artists is not only a property rights, but a special kind that has a dual nature and involves two aspects, that is to say, literary and financial, and this right can be seen as a literary right and a financial right. among the most important recommendations of the researcher is the need to spread the culture of the rights of performers in the Sudanese society by all means of communication, and to entrust the management of the financial services to the management of intellectual property to specialized bodies in Sudan, to be supervised by the Ministry of Justice and enact laws regulating and enforcing them.
