ترجمة الملخص

Praise God, we praise Him, and we seek His forgiveness, and we repent to Him, and we seek refuge in God from the evils of ourselves, and from the evils of our deeds. He whom God guides is the guided one, and he who misleads, there is no guide for him, and I bear witness that there is no god but God alone who has no partner, and I bear witness that Muhammad is His servant and Messenger, distance:This treatise is entitled: "Mohammed bin Al-Hassan's narration of Al-Muwatta and its impact on Hanafi jurisprudence." Submitted to obtain a high degree "Masters" in jurisprudence and its origins.I studied the issues in which Imam Muhammad bin Al-Hassan was influenced by Imam Malik, through his narration of Al-Muwatta, in violation of his doctrine, and among the jurists of the Hanafi school of thought agreed with him with his opinion contrary to the opinion of Imam Abu Hanifa. The study aims to:First:To highlight the role of Imam Muhammad ibn al-Hasan al-Shaybani in Islamic jurisprudence, and his position among scholars. Second:Proving that many scholars did not confine themselves to one sect, but rather drew from several sects, and among them is Imam Muhammad bin Al-Hassan Al-Shaybani. Third: Clarifying the issues in which Imam Muhammad bin Al-Hassan was influenced by Imam Malik's opinion, and in which he contradicted the doctrine of Imam Abu Hanafia through his narration of Al-Muwatta. This study followed the inductive, descriptive, transfer, analytical and comparative method. The study is divided into an introduction, a preface, three chapters, a conclusion, and technical indexes. Introduction: It contains a brief definition of the subject, the reasons for choosing it, its objectives, its problematic, its limits, previous studies, its method, and its division. The preface-which includes the translation of Muhammad ibn al-Hasan al-Shaybani. Chapter One-Introduction to the book Al-Muwatta and its companion. Chapter Two-Issues in which he disagreed with Abu Hanifa regarding worship. Chapter Three-The issues in which Abu Hanifa disagreed from various chapters. Conclusion-it included the most important results.
