ترجمة الملخص

The researcher chose this research because of the urgent need for the Muslims in general and the medical personals in particular to be aware of Islamic rulings in matters that are constantly evolving due to the advancement and progress in technology. This work has not been easy due to the nature of this research where most of the documentation were in English and at the same time many technical issues words were a major challenge which necessitate occasional meetings with medical practitioners in order to explain some complicated and technical issues. The researcher confirmed that Islamic rulings relating to contemporary medical issues and scientific research fall into four different categories. The first category is related to those contemporary issues thathave been debated by Muslim scholars and unanimous rulings have been issued on these matters. The second category concerns various issues that has been recent occurred and are subject to difference of opinion where no common rulings has been reached to date. The third category tackled in this thesis are issues that have been previously studied along with appropriate rulings, except that the researcher feel that these previous rulings are subjected to changes due to the same progress and advancement in research and technology. the fourth category is related to issues that to the researcher’s opinion has not been sufficiently studied and its rulings is not therefore not appropriate as in the case of Medical hypnotherapy. The researcher has come to realise that one of the major obstacle is finding an appropriate ruling on each of the contemporary issues is the level of difference of opinions and the various legal entities which ironically complicate the issue of a standard rulings to the laymen and the medical practitioners in particular while, at the same time, the researcher feels that not all scholars should be tempted to issue Islamic rulings on contemporary matters except with if they are ready to willing and ready to specialize in these contemporary legal issues. Also, the researcher tries to tackle various legal issues that were not previous studied. Finally, the researcher points out the general conclusions that have been achieved through this thesis, then made a number of recommendations while voicing the necessity of cooperation between Muslim scholars and fiqh councils to share knowledge and experiences and work towards the unity of the academies or at least decrease the contradiction of fatwas between members of different fiqh academies in relation to serious and urgent Islamic issues
