- The current study examined the civil liability of the proxy in Jordanian law, where the proxy expresses their own will, not that of the principal. This means that the action taken by the proxy is attributed to the principal, and it reflects the concept of concealed agency, where the principal hides their name in the transaction entrusted to the proxy, for one reason or another. In a proxy contract, it is a requirement that the proxy acts in their own personal name. The study yielded the following results: In general, agency is a contract in which the agent commits to perform some legal actions in their own name on behalf of the principal in exchange for a commission. The Court of Cassation has ruled that "the effect of proxy provisions is that the actions performed by the agent are considered to have emanated from the principal, and thus, the legal actions carried out by the agent are directly attributed to the principal, and the agent remains separate from this effect." (Cassation Case No. 139 of 1981). The Supreme Administrative Court, in its judgment No. 606 of April 18, 2000, established that "the commercial agent contracts on behalf of the principal, and the principal is the essence of the contract, not the agent. The agent's actions are limited to what is necessary to execute the assigned work, and the agent receiving a commission cannot be a party to the quality of the work undertaken for the account of the principal. Therefore, filing a lawsuit against the agent jointly with the principal is not permissible if the agreed-upon principle is that joint liability is not implied." Jordanian legislation includes various types of legal agencies, such as special agencies, general agencies, and non-isolable special agencies. The existence of these agencies and their legal status within specific objective and formal conditions specified by the law has encouraged individuals to appoint others to carry out legal actions that permit the use of these agencies. Jordanian lawmakers have regulated various means of evidence in legal texts, but each of these requires separate research to discuss them further due to the abundance of information related to them.
