الملخص

يتمحور موضوع الأطروحة حول الإشراف القضائي على تنفيذ العقوبات البديلة حيث يكتسي الموضوع أهمية من عدة نواحي أولها جداته ويتجلى ذلك من خلال حداثة هده الأنظمة العقابية البديلة وأهميتها في ترشيد السياسة العقابية الحديثة حتى تحقق الإصلاح والتأهيل ,هذا الأخير يرتبط أساس بفعالية الإشراف على تنفيذها من طرف القاضي المختص فضلا عن أهمية مرحلة التنفيذ العقابي التي تعتبر من أهم المراحل لأن نجاح السياسة الجنائية في تحقيق هدفها مقترن بهذه المرحلة ,وتم طرح تساؤل حول مدى كفاية السلطات الممنوحة لقاضي تطبيق العقوبات في مجال تنفيذ العقوبات البديلة في تحقيق إصلاح وتأهيل وإعادة إدماج المحكوم عليه في المجتمع كهدف تسعى السياسة العقابية الحديثة إلى تحقيقه وتمت الاجابة عن ذلك في بابين الأول خصص للأحكام العامة للإشراف القضائي على تنفيذ العقوبات البديلة أما الباب الثاني تضمن حدود إشراف قاضي تطبيق العقوبات على تنفيذ العقوبات البديلة وتم التوصل إلى نتائج أهمها عدم استقلالية قاضي تطبيق العقوبات وارتباط فعالية دوره بهيئات أخرى , وتدخل السلطة التنفيذية في بعض السلطات التي هي في الأصل من اختصاصه وتم اقتراح ضرورة تكريس استقلالية قاضي تطبيق العقوبات في التشريعات العقابية وتوسيع سلطاته في تنفيذها ,وتفعيل الهيئات المرتبطة به من حيث إعادة تشكيلتها وتفعيل دور المجتمع المدني.

ترجمة الملخص

The present thesis tackles the judicial supervision in the execution of alternative penalties; where the topic is of great importance in many ways, first of it, it is a new topic in a way these alternative penalty systems are modern ones, and are important in the rationalization of the modern penalty policy in order to achieve the reform and rehabilitation, this later is tightly related to the efficiency of the execution supervision of the authorized judge, as well as the importance of the penalty execution stage which is considered as an important phase; because the success of the penal policy in reaching its goal is tightly linked to this stage, a question has been raised on whether the powers given to the penalty execution judge were sufficient in the field of alternative penalty execution to achieve the reform of the convict, its rehabilitation and reintegration in the society as an aim to be reached by the modern penal policy? The answer was given in two sections; the first one was devoted to general judgements of judicial supervision in executing alternative penalties, whereas the second one was dedicated to the limits of judge’s supervision in the execution of alternative penalties, among the results we found: the lack of independence of the penalty execution judge and the correlation of the efficiency of his role with other bodies, and the intervention of the executive authority in some of his powers which are originally his. We suggested the necessity of true independence of the penalty execution judge in punitive legislation and the enlargement of his powers in their execution, as well as the activation of the related bodies in the way they are set and the reinforcement of the role of the civil society.
