ترجمة الملخص

After a close analysis of the cases examined, the researcher concludes that they encompassed five main types of crime including treason against the state which wasfound to have the highest statistical rate of 26.7% , followed by the crimes of theft,adultery and hashish smuggling each with a rate of 20% and, finally, drug trafficking which has a rate of 13.3%. Enforcement of those punishments has always been carried out with due con-sideration given to extenuation circumstances based on the well-known Shari‘a Prin-ciple: “inconclusive evidence wards off Prescribed Punishments“ which underlinesthe vital importance of this principle with respect to the Prescribed Penalties and thefact that it is being widely observed as a common practice in court inasmuch as theactual enforcement of penalties is concerned. The principle: “Discretionary Punish-ments must always be carried out with an eye to the common good“ was also ob-served with equal respect in the treatment of Discretionary Punishments.
