ترجمة الملخص
This study came at a time we are in need to know all that is related to the international custom and legal rules and principles that must be applied on the joint Palestinian Israeli flowing water specially underground water due to the political junctures in Palestine ranging between peace and the Intifada (Palestinian uprising). So long as the issue of the Palestinian water is a stalled one between the Palestinians and the Israelis, it should be solved very speedily. Israel is in control of most of the water sources in the region not heeding the share of the other partner. In order to provide enough water for the Palestinians to develop and prosper them economically and socially rules of international law pertaining to the joint flowing water must be implemented applied. Water is a basic element for life in its entire social, economic,Industrial, developmental and political aspects. It is a basic issue for the world countries to settle problems over which in order to attain all aspects of development. So long as there are two sources of the Palestinian water; surface and groundwater, I wanted to focus my study on the groundwater of Palestine for it makes up a high percentage of the Palestinian water sources. The study discussed in two main chapters preceded by a preliminary chapter discussing the historic development of the international legal system of the surface and the groundwater and the nature of the relation between them .The first chapter of the study discussed the Palestinian water sources and the legal nature of the Palestinian water. The second chapter discussed the scope of application of international principles on the joint western groundwater cistern between the Palestinians and the Israelis. The study concluded that there are Palestinian water rights recognized by the United Nations in line with the resolutions adopted by the General Assembly and the Security Council. The Palestinian National Authority has the right to control its water sources. Israel recognized the Palestinian water rights without determining their water resources in the Declaration of Principles and Oslo accords of 1995 .The study found that there are water cisterns shared by Palestine and Israel as they flow into the Green Line. Both parties must share them and preserve them. The most important of which is the sample of the Study; the Western ground aquifer. There are other cisterns that must be totally under Palestinian control for they are national cisterns located in the Palestinian National Authority areas .They do not flow into the Green Line such as the Eastern cistern . ‌و‌The study concluded that there could be no final solution of the joint groundwater question between the Palestinians and the Israelis unless several factors are available. The most important of which are the social and political stability in order to determine the percentage of the Palestinian population and the necessity to cooperate between them in order to have the best usage of joint water whet herin the groundwater or in the surface water. The study recommended a discussion of the bilateral Palestinian Israeli agreements and absorption of the previous mistakes and study of which besides preparation of a legaland hydrological team in order to deal with the question and put up the appropriate rules in order to settle the issue of the Palestinian water especially water shared by other parties .We also recommend negotiations over water taking into account criteria of the World Health Organization of the average needed by each individual which is 150 cubic meters per capitaper annum .Due to the large number of organizations catering for water including the Water Authority, the Hydrological Group and the Ecological Quality Authority, the role of each organization must be determined in order to avoid intertwining of specialtization, competition and confusion between these institutions. Most important is to get real information about the Palestinian water .This could be done through the creation of an information bank that includes all the true information about the Palestinian water wealth
