الملخص

يعتبر الحرم الجامعي أحد أهم الروافد الاجتماعية في أي دولة ، فهو المحيط الاسمى الذي يظم النخبة من أبناء المجتمع سواء على مستوى العاملين فيه كتدريسيين من أهل العلم والدراسات العليا ، وغيرهم من ملاكات الإدارة ، أو الطلبة الذين يمثلون الأساس الذي ترتكز عليه حركة البناء وحركة النهوض والرقي والتطور في المجتمع ، فإن المساس بالحرم الجامعي يعد من المسائل الخطيرة التي تشكل نواة للمساس بالمجتمع كونه الصرح الأكثر حضوراً فيه والأكثر فعالية ، مما يتطلب أن تكون هناك مسؤولية جزائية عن أي محاولة للمساس بالحرم الجامعي من خلال التعرض لمن داخل الحرم الجامعي من أشخاص بغض النظر عن الصفة التي يحملونها فللحرم الجامعي حرمته الكبيرة . وأن المساس بأي شكل من الاشكال بمن يدخل الحرم الجامعي ويتواجد فيه تنتج عنه مسؤولية جزائية حسب القوانين النافذة ومن ذلك ما قد يصدر من الطالب الجامعي من سلوك يخالف القانون ويتجاوز عليه ، إزاء احد الافراد المتواجدين داخل الحرم الجامعي سواء كانوا تدريسيين أو طلبة أو عاملين أو مرتادين للحرم الجامعي بصفة رسمية أو اعتيادية ، أو ممن لديهم مراجعات داخل الحرم الجامعي من ذوي الطلبة او غيرهم ، حيث يتحمل الطالب الجامعي المسؤولية الجزائية وفقا للقانون إزاء هذا السلوك وهي المسؤولية الجزائية للطالب الجامعي داخل الحرم الجامعي لتصبح عنواناً لدراسة متخذة من قوانين العراق ومصر والأردن انموذجاً لها في بيان حجم المسؤولية التي تقع على عاتق الطالب الجامعي داخل الحرم الجامعي في حالة صدور أي سلوك منه يعتبر فيه تعدي على الآخرين حيث يجرمه القانون ويعاقب عليه . سواء القيام بالعمل من شانه الاخلال بالنظام العام والطمأنينة والسكينة داخل الحرم الجامعي وغير ذلك من الآخرين أم غير ذلك من المساس بالآخرين وخصوصياتهم الشخصية والدينية والعرقية أو القومية ، أو اتباع سلوك التهديد والابتزاز داخل الحرم الجامعي وبما يشكل جريمة تلحق خطرا وضررا بالمتواجدين داخل الحرم الجامعي ، في أي وقت من الأوقات حرمة لهذا المكان واهميته. حيث ركزت الدراسة على بيان ماهية المسؤولية الجزائية التي تقع على عاتق الطالب الجامعي داخل الحرم الجامعي ، والتي تمهد للمساس بالمصلحة العامة التي يعد المساس بها أحد أهم الأسس التي تود لإشاعة روح الخوف وعدم الاستقرار والأمن والأمان داخل المجتمع ، ثم بيان الأسس القانونية التي تؤسس للمسؤولية الجزائية التي تقع على عاتق الطالب الجامعي داخل الحرم الجامعي إذا ما ارتكبت سلوكاً يخالف القانون ويجرمه القانون ويعاقب عليه من خلال المبادئ القانون للقوانين محل الدراسة التي تحدد ماهية وحجم المسؤولية الجزائية للأفعال التي يمكن تقع من الطالب الجامعي داخل الحرم الجامعي ومنها بالذات المسؤولية الجزائية عن المساس بالمعتقدات الدينية سواء بالازدراء عليها أمْ المساس بالشخوص المقدسة أم الشعائر والأماكن الدينية للآخرين أمْ إثارة الفتنة بأشكالها وصورها المختلفة من خلال التحريض الترويج أو الإساءة للآخرين بغض النظر عن انتمائهم الديني أو العرقي أو القومي. وتعرضت الدراسة لسلوك آخر داخل الحرم الجامعي عند ارتكابه يحمل الطالب مسؤولية جزائية حسب القوانين الصادرة وهو التهديد والابتزاز خاصة الالكتروني الذي يعد من اكثر صور الابتزاز حضوراً في عالمنا المعاصر. وأنهيت الدراسة بخاتمة تضمنت أهم النتائج والمقترحات التي شخصت مواطن القوة والخلل في التشريعات النافذة وما يحتاج أليه الموقف التشريعي من تعديل .

Harming in any way anyone who enters the university campus and is present therein results in criminal liability according to the laws in force, including behavior that may be issued by a university student that violates the law and transgresses it, towards one of the individuals present on the university campus, whether they are teachers, students, workers, or attendees to the university campus in an official or regular capacity, or to those who have reviews on the campus from the students’ families or others, where the university student bears criminal responsibility in accordance with the law regarding this behavior, which is the criminal responsibility of the university student inside the university campus to become the title of a study taken from the laws of Iraq, Egypt, and Jordan as a model. In explaining the amount of responsibility that falls on the university student on campus in the event of any behavior on his part, it is considered an assault on others, as the law criminalizes it and punishes it.
