الملخص

هدفت هذه الدراسة إلى معالجة أحوال الجد والأحفاد في الميراث و ذلك في كل من القانون والشريعة الإسلامية، حيث قسمت هذه الدراسة إلى فصلين، في الفصل الأول تم التطرق إلى أحوال الجد في الميراث في الفقه والقانون، تم التناول فيه المقصود بالجد، وهو الجد الصحيح الذي لا يدلي إلى الميت بواسطة أنثى بل بواسطة ذكر، فينزل منزلة الأب في الميراث و ذلك عند عدم وجود الأب، وهذا في بعض الحالات، ويختلف في بعض الحالات و ذلك عند اجتماعه مع الإخوة، وهذا الاختلاف اختلاف فقهي، وقد أخذ المشرع الجزائري بما ذهب إليه المذهب المالكي الذي استمده من زيد بن ثابتـــ رضي الله عنه ـــ .وفي الفصل الثاني تم التحدث عن أحوال الأحفاد في الميراث، تم التطرق فيه إلى الحالات العادية وغير العادية، ففي الحالات العادية نجد أن كل من الفقه والقانون لم يختلفوا فيها، وفي الحالات غير العادية أو ما يسمى بالتنزيل ( الوصية الواجبة )، تم التطرق فيه إلى تعريف التنزيل وأركانه وشروطه، وكذلك إلى أحكام التنزيل في كل من قانون الأسرة الجزائري والقانون المقارن

ترجمة الملخص

This study dealt with the situation of grandchildren in inheritance in both Islamic law and Sharia. The study was divided into two chapters. The first chapter talks about the situation of grandparents in inheritance according to Islamic Fiqh and the law . It dealt with case where the grandparents are not related to the deceased from female side but rather from male side who establishes the status of the father in inheritance when the real father is not present and it differs in some cases when meeting with brothers and this difference is considered as a jurisprudential dispute. That what is the Algerian legislature has adopted from malki doctrine that was divided from Zeid ben Thabet "God s approval of him" .The second chapter deals with inheritance status of grandchildren. It deals with ordinary and unusual situations . In the ordinary cases where there is no difference between the Juris and the law , and concerning the unusual cases or what is known as obligatory will we gave its definition , elements and conditions and also present obligatory will provisions in both Algerian family law and comparative law Cette étudeportait sur la situation des petits-enfants en matièred héritagetant dans la loi islamique que dan la Charia. Létudea été diviséen deux chapitres. Lepremier chapitre traite la situation des grands-parents en matièred héritageselon le Fiqh islamique et la loi. Elletraitait d un cas ou les grands-parents ne sont pas apparentes au défuntdu cote fémininmais plutôt du cote masculin qui établitle statut du père dans l héritagelorsque le vrai père n est pas présentet qui il diffèredans certains cas lorsqu’il rencontre des frèreset cette différenceest considéréecomme un différendjurisprudentiel.Que ce qui est le législateur algérien a adopte de la doctrine Malki qui était divise de Zeid Ben Thabet"l approbation du Dieu de lui".Le deuxième chapitre traite du statut successoral des petits-enfants. Il trait de situations ordinaires et inhabituelles. Dans les cas ordinaires ou il n y a pas de différence entre le Juris et la loi et concernant les cas inhabituelles ou ce que l on appelle la volante obligatoire nous avons donnésa définition , les éléments et les conditions et aussi présenter des dispositions de volante obligatoire dans les deux lois algérienne de la famille et droit compare.
