الملخص

هدفت هذه الدراسة إلى إبراز أثر الذكاء الاصطناعي على إبرام وتنفيذ علاقة العمل، من خلال تحليل أهم تطبيقاته وانعكاساته القانونية. وتوصلت إلى أن هذه التقنيات أسهمت في تطوير إجراءات التوظيف وإبرام العقود، وتحسين تنفيذ الالتزامات التعاقدية عبر العقود الذكية وتقنية البلوك تشين، بما يعزز الكفاءة والسرعة والدقة. كما بينت الدراسة أن استخدام الذكاء الاصطناعي يثير عدة إشكالات قانونية وأخلاقية، من أبرزها التحيز الخوارزمي، المساس بالخصوصية، وصعوبة تحديد المسؤولية عن الأضرار الناجمة عنه. وانتهت إلى ضرورة مواكبة التطورات التكنولوجية بإطار تشريعي ملائم يكفل الاستفادة من مزايا الذكاء الاصطناعي مع ضمان حماية حقوق أطراف علاقة العمل.

This study aims to highlight the impact of artificial intelligence on the formation and execution of employment relationships by analyzing its main applications and legal implications. The findings indicate that these technologies contribute to improving recruitment procedures and contract formation, as well as enhancing the execution of contractual obligations through smart contracts and blockchain technology, thereby increasing efficiency, speed, and accuracy. However, the use of artificial intelligence raises several legal and ethical challenges, particularly algorithmic bias, privacy concerns, and difficulties in determining liability for damages caused by such technologies. The study concludes that an appropriate legal framework is necessary to maximize the benefits of artificial intelligence while ensuring the protection of the rights of the parties involved in the employment relationship. (Cette étude vise à mettre en évidence l’impact de l’intelligence artificielle sur la conclusion et l’exécution de la relation de travail, à travers l’analyse de ses principales applications et de leurs implications juridiques. Les résultats montrent que ces technologies contribuent à l’amélioration des procédures de recrutement et de conclusion des contrats, ainsi qu’à l’exécution des obligations contractuelles grâce aux contrats intelligents et à la technologie blockchain, renforçant ainsi l’efficacité, la rapidité et la précision. Toutefois, l’utilisation de l’intelligence artificielle soulève plusieurs défis juridiques et éthiques, notamment les biais algorithmiques, l’atteinte à la vie privée et les difficultés liées à la détermination de la responsabilité en cas de dommages. L’étude conclut à la nécessité d’un cadre juridique adapté permettant de tirer profit des avantages de l’intelligence artificielle tout en garantissant la protection des droits des parties à la relation de travail).
