ترجمة الملخص

The thesis takes up the Development of the constitutional move in Kuwait between( 1938- 1961) and the research based on the identification of the nature between the relation between the Rulers and those ruled in Kuwait . It is identical to a social chain , but it had changed step by step into a sovereign reign after Shaikh Mubarak Bin Sabah reached reign . The thesis takes the developments that happened after the death of Mubarak which led to popular demands for the return of the elite’s participation in making the decision and whatever constitutional steps that followed which started in establishing “ Shora Council “ in 1921 , then Legislative Council 1938 and 1939 . This thesis displays the efforts of the commercial elite to push forward the constitutional development through insisting on their right in participating in making the decision which led to armed clash , the first of its kind in the history of Kuwait . The study analyses the conditions that led to take the strategic decision of the constitutional rights after Shaikh Mubarak Bin Sabah reached reign until the elections of the constitutional council which set up the constitution , along with a demonstration of the most important events that accompanied the declaration of the constitution in its final formation
