الملخص

تناولت هذه الدراسة موضوع الحقوق الزوجية قبل الزفاف (دراسة فقهية مقارنه)، وقد هدفت الدراسة إلى التعريف بالمقصود بالحقوق الزوجية بعد العقد وقبل الزفاف، وبيان حقوق كل من الزوج والزوجة بعد العقد وقبل الزفاف، وبيان الأحكام المترتبة في حال وقوع مخالفات بين العاقديْن، بعد العقد وقبل الزفاف. ولتحقيق هذه الأهداف كان لا بد من الإجابة عن الأسئلة التالية ما هي الحقوق الزوجية التي تكون بعد العقد وقبل الزفاف؟ ما هي الحقوق الزوجية في حال الطلاق بعد العقد، وقبل الزفاف؟ ما الاحكام المترتبة في حال وقوع مخالفات بين العاقديْن، بعد العقد وقبل الزفاف؟ واتبعت الباحثة المنهج الاستقرائي الوصفي التحليلي؛ وذلك من خلال استقراء المادة العلمية المتعلقة بموضوع الحقوق الزوجية قبل الزفاف وجمع أقوال الفقهاء في المسائل المرتبطة بهذا الموضوع وتحليلها ثم الترجيح بينها.وخلصت الدراسة إلى جملة من النتائج أهمها: أن جزء من الحقوق التي تمت دراستها تثبت للعاقدين بعد الزفاف وإعلان الدخول فلا تثبت بمجرد العقد؛ كحق القوامة للزوج، وحق الطاعة، وحق النفقة للزوجة، والحق في المعاشرة الزوجية. وهناك حقوق تثبت بمجرد العقد؛ كحق العاقد في زيارة المعقود عليها، وحق المهر عند الاتفاق على كونه معجلاً كله أو بعضه، والحق في الهدايا والمتطلبات العرفية للمعقود عليها، وحق الزوجين في المعاملة بالمعروف، وثبوت النسب مع وجود الخلوة، وحق التوارث بين الزوجين.الكلمات مفتاحية: الحقوق، الزوجية، قبل الزفاف، حقوق العاقد، حقوق المعقود عليها، حقوق مشتركة.

This study dealt with the subject of marital rights before marriage (a comparative jurisprudential study). In order to achieve these goals, the following questions had to be answered: What are the marital rights after the marriage contract and before the wedding? What are the marital rights in the event of divorce after the marriage contract and before the wedding? What are the rulings in the event of irregularities between the two parties, after the contract and before the wedding? The researcher followed the inductive descriptive-analytical method. This is done by extrapolating the literature related to the subject of marital rights before marriage, collecting the sayings of the jurists on issues related to this subject, analyzing them, and then weighing them.The study concluded with the following main results: part of the rights that were studied are established for the two contracting parties after the wedding and the declaration of entry, so they are not established by mere contracting; Such as the right to guardianship for the husband, the right to obedience, the right to alimony for the wife, and the right to marital cohabitation. And there are rights that are established by mere contract; Such as the right of the contracting party to visit the contracted woman, the right of the dowry when it is agreed that it is all or part of it in advance, the right to gifts and the customary requirements of the contract, the right of the spouses to treat with kindness, the proof of lineage with the existence of solitude, and the right of inheritance between the spouses
