الملخص

اهتم علماء القانون والجريمة والاجتماع الجنائي بالتطورات الحاصلة في مسارات الجريمة على الصعيدين الوطني والدولي، ولاحظوا تزايداً مخيفاً في جرائم الاتجار بالبشر والاعضاء البشرية. اذ لم تعد هذه الجرائم محددة في النظام الوطني او الداخلي، وانما امتدت عبر الدول بشكل متسارع، واصبحت تجارة كبرى دخلت عالم الجريمة المنظمة في ضرورة مكافحتها واتخاذ الاجراءات اللازمة للحد منها.وبذلك تكتسب هذه الدراسة اهمية خاصة في جانبها العلمي والتطبيقي. وتبرز الأهمية العلمية من خلال اعتبار هذه الدراسة من الدراسات الحديثة التي تهتم بمعالجة احد اخطر الظواهر الاجرامية على المستويين الوطني والدولي. حيث تحاول هذه الدراسة سبر اغوار ظاهرة اجرامية غامضة ومؤرقة على كافة المستويات، بهدف محاولة استجلاء هذه الظاهرة وكشف بعض الغموض الذي يعتريها.وفي جانبها التطبيقي تفيد هذه الدراسة العاملين في المؤسسات ذات العلاقة بمكافحة هذه الظاهرة بما في ذلك وزارات الداخلية، من خلال رسم خطط تنفيذية معينة للتصدي لها والتقليل من حجمها.وتكمن اهمية البحث في مجال الدراسة ان جريمة الاتجار بالبشر تقوم في المقام الأول على مضمون استغلال العنصر البشري بارتكاب الجريمة، حيث بلغ بمرتكبيها النظر الى البشر على انهم سلع قابلة للبيع والشراء، وهو ما يمثل انتهاكاً صارخاً لحقوق الانسان بما ينطوي عليه من امتهان لكرامة الانسان وادميته، وما تحمله هذه الظاهرة بين طياتها من اثار سلبية على الانسان بصفة عامة وعلى المجتمعات البشرية بصفة خاصة.كما ان دخول العبودية بمفهومها التقليدي والحديث الى الانظمة الاساسية للمحاكم الجنائية الدولية، وورودها على انها احدى الجرائم الدولية التي يتم ملاحقة مرتكبيها ومحاسبتهم، زادت من اهمية وخطورة هذه الظاهرة ، واصبح من الضروري الحديث عنها كنوع مستقل من الجرائم الدولية التي ترتكب ضد الجماعات في زمن الحرب وزمن السلم.

If rejected slavery and bondage in its old form , so it was rejected of all forms of modern slavery which is known by human traffic, because result waste of human dignity. And that the idea of the slave traffic have emerged since time immemorial in different countries as a traffic commodity markets bought to do service work, and the slave purchased in the era of slavery or pre-Islamic as an owned by a lady who had purchased. This phenomenon took another turn affects the dignity and inhuman person, whether male or female motivated by the need to supplies of primary food, clothing and shelter, and now human traffic has other aims are to provide the means to commit criminal behavior, and has become one of the most important elements of organized crime and international crime, cross-border and results as various multinational prostitution, so that man becomes a criminal by entering the case of those organizations. And have become a social phenomenon as a traffic generate profits for those who made it on the one hand and the other hand, provide the necessary human element to commit crimes, including arranged crime and crimes made professionally. The Importance of Research The importance of research in the field of study that the crime of human trading based primarily on the content of the exploitation of the human element by commit a crime, whether he is an original perpetrator of a crime or partner directly or he enter in this crime as a result. His perpetrators ( the crime of traffic of human) to look at human beings as they are commodities subject to sale and purchase, which represents a violation for human rights, including implied from the affront to human dignity and his humanity, and afford this phenomenon among carries negative effects on humans in general, and then to communities in particular. 2 Search problematic What increased in highlighting the problem of human traffic is the fact that most of the images relating to a vulnerable group in society of women and children, and being one of the activities of organized crime, which was the subject of one of the three protocols annexed to the United Nations Convention against Transnational Organized Crime of 2000. This kind of attack on such type and other members of the community is a problem that deserves research and invites us to see shapes and views of this crime and the attitude of criminal legislation. It is also the trading of women and children for prostitution and forced labor are among the most growing problems in the world. The nature of this phenomenon requires an effective movement between countries, to transport victims of this traffic from their local communities to other areas are often outside their own countries. Research Methodology The nature of the crime of trading in human beings followers of the analytical method and comparative inductive, to determine the nature of the crime of human trading in the criminal legislation in jurisprudence aided in all this research and scientific studies, both those included in books or in specialized scientific journals or in the international information network sites. Research Plan We decided to divide our study into three chapters, we have identified in the first chapter the concept of the crime of human beings trading and so on three topics: The first section dealt with in the definition of the crime of trading in human beings, and we have dedicated the second part of the characteristics of the crime of trading human beings, and we talked in the third section to distinguish the crime of trading in human beings for the like. In the second part of this study, we dealt with elements of the crime of in human beings trading first material element of the crime as a title for the Study, and the emotional element of the crime in human beings trading as a title for the second section. In the third chapter make to discuss the most prominent crimes related crime of human trading, which will be subject to search, distributed within the two main points we discussed in the first point of crimes related crime of human trading as a national crime , and allocated the second point to clarify crimes related crime of human trading as a crime against humanity .
