الملخص

يركز هذا البحث علي التعريف بالتوقيع الإلكتروني في النظم القانونية المقارنة والوقوف علي صوره وتطبيقاته المختلفة ومزاياه وعيوبه ومدي تحقيقه لشروط التوقيع اليدوي وبيان أطراف عملية التوقيع الإلكتروني ، وتوضيح حجيته في الإثبات من حيث الشروط المطلوبة في التوقيع الإلكتروني حتى يتمتع بالحجية ويحصل علي الحماية القانونية والشروط الشكلية لهذه الحجية ومدى قبول التوقيع الإلكتروني في الإثبات وبيان الأثر القانوني لهذا القبول في الإثبات.القانون نظم حماية قانونية لهذا التوقيع وذلك بإضفاء عملية تامين بيانات التوقيع من حيث التشفير والتوثيق لدي طرف ثالث يضطلع بعملية توثيق التوقيع الأكثر وإصدار شهادات تثبت هذا التوثيق وذلك تدعيماً للأمان والثقة في التوقيع الإلكتروني.يتطرق البحث كذلك للحماية الجنائية للتوقيع الإلكتروني وذلك بتحديد الأفعال المجرمة التي تقع علي التوقيع وبيان العقوبة المقررة لكل فعل ، كل ذلك مسبوقاً بتعريفه بطبيعة الجرائم المعلوماتية وأنواعها ومرتكبيها وأصنافهم وخصائص هذه الجرائم التي من بينها الجرائم الواقعة علي التوقيع الإلكتروني.البحث تناول الموضوعات أعلاه مقارناً بين التشريع السوداني وبعض التشريعات العربية والأجنبية.Abstract This research focuses on defining electronic signature in the comparative legal systems through exploring its forms, applications , advantages and disadvantages and to what extend it fulfills and meets the terms and condition of the manual signature and how to determine the parties in the electronic signature further more the research tries to clarify the authenticity of electronic signature in proofing so as to have legal protection, and to what extend is legal signature accepted in proofing. The legal system provides legal protection to electronic signature through adding a process of securing signature date in terms of coding and documentation with third party concerned with issuing certificates that prove such documentation in order to support security and trust on electronic signature. The research also discusses the criminal protection of the electronic signature through determining the criminalized acts on the signature and the penalties to each act, this will be preceded by defining cyber crimes and its forms, criminal and characteristics among which the electronic signature is in cluded. The research method was a comparison between Sudan legislation and foreign legislations.
