الملخص

تناولت هذه الدراسة موضوع " جرائم قرصنة مواقع التواصل الاجتماعي فيسبوك نموذج " وذلك من خلال فصلين متكاملين، حيث كان الفصل الأول بعنوان "الأحكام الموضوعية لجرائم قرصنة حسابات الفيسبوك نموذجا "،ففي البداية تم تسليط الضوء على تحديد ماهية حسابات التواصل الاجتماعي بشكل عام والفيسبوك بشكل خاص،ومن ثم التركيز على مفهوم هذه المواقع بحيث تحدثنا عن خصائصها و نشأتها و بعدها تعرضنا إلى صور مواقع التواصل الاجتماعي وأهميتها، كما ركزنا ايضا على موقع الفيسبوك من خلال التعريف به وذكر أهم مميزاته، وتطرقنا كذلك إلى صور قرصنته وذلك وفقا للتشريع الجزائري التي نص عليها في قانون العقوبات وكذلك قانون 18/07، والتي تم من خلالهما تحديد العقوبات المقررة لكل جريمة من جرائم قرصنة حسابات الفيسبوك.اما الفصل الثاني فكان بعنوان "آليات الإجرائية الخاصة بمتابعة جرائم قرصنة حسابات الفيسبوك "فتطرقنا في بدايته إلى الآليات الإجرائية الإدارية، فبين فيها ماهية السلطة الوطنية لحماية المعطيات الشخصية، وكذلك اجراءات الادارية المقررة في حالة مخالفة القانون 18/07، وبعدها تعرضنا إلى الآليات الاجرائية الجزائية، وختمنا هذا الفصل بشرح خصوصية جرائم المعطيات من حيث إجراءات المتابعة والتحقيق ومن حيث إجراءات المحاكمة

ترجمة الملخص

This study dealt with the topicof "Facebook piracy crimes as a model" through two integrated chapters, where the first chapter was entitled "Objective provisions for piracy crimes of Facebook accounts as a model". In particular, and then focus on the concept of these sites so that we talked about their characteristics and their inception, and then we were exposed to the images of social networking sites and their importance. The Algerian legislation stipulated in the Penal Code, as well as Law 18/07, through which the penalties for each crime of hacking Facebook accounts were determined. As for the second chapter, it was entitled “Procedural mechanisms for following up on Facebook account hacking crimes.” Administrative procedural mechanisms, in which he explained the nature of the National Authority for the Protection of Personal Data, as well as the administrative procedures established in the event of a violation of Law 18/07, and then we were exposed to the procedural and penal mechanisms, We concluded this chapter by explaining the privacy of data crimes in terms of follow-up and investigation procedures and in terms of court procedures. Cette étude a traité le thème des « Crimes de piratage Facebook comme modèle » à travers deux chapitres intégrés, dont le premier chapitre était intitulé « Dispositions objectives pour les crimes de piratage des comptes Facebook comme modèle ». En particulier, puis se concentrait sur le concept de ces sites afin que nous parlions de leurs caractéristiques et de leur création, puis nous avons été exposés aux images des sites de réseaux sociaux et de leur importance.La législation algérienne prévue dans le Code pénal, ainsi que la loi 18/07, par laquelle les sanctions pour chaque délit de piratage de comptes Facebook ont été déterminés. Quant au deuxième chapitre, il était intitulé « Mécanismes procéduraux de suivi des délits de piratage de compte Facebook ». Données personnelles, ainsi que les procédures administratives établies en cas de violation de la loi 18/07, puis nous avons été exposés aux mécanismes procéduraux et pénaux, Nous avons conclu ce chapitre en expliquant la confidentialité des délits liés aux données en termes de procédures de suivi et d'enquête et en termes de procédures judiciaires.
